Why notaries are so important
That means a notary cannot be a party to the transaction they’re notarizing or allowed to have any financial interest or benefit from that transaction. This also means that notaries can’t notarize their own signatures, nor the signatures of anyone related to them by a marriage or adoption. [ARS 41-328(B)]
The main purpose of the notary is to reduce the possibility of fraud, forgery, identity theft, and similar crimes. That task is accomplished by requiring that a signer (signatory) to appear before the notary in person, and prove identity by showing identification.
The notary seal
- Rubber stamp not larger than 1.5 inches high and 2.5 inches wide, or 1.5 inches in a round shape
- Dark ink with allowed colors black, dark purple, dark blue, dark green, or brown
- Red ink or any color not easily photocopied is not allowed
- Must contain the words “Notary Public” as well as the notary’s name, as well as the Great Seal of the State of Arizona
- As a fairly recent requirement, the notary’s seal must now also contain their commission number [ARS 41-313(D)(2)]
Notarize a signature
Notarizing the signatures on AZ legal documents usually means administering oaths and taking acknowledgments. Assuming your document is prepared correctly, and also assuming you satisfactorily identify yourself to the notary and assert you’re willing to sign, then he oath is administered as prescribed by law.
It’s a simple question to be answered affirmatively: “Do you solemnly swear the information contained in this document is the truth, so help you God?”
Religious objections against swearing an oath
If religious or philosophical beliefs would prevent you from invoking the Deity or swearing an oath, don’t worry – Arizona law allows an acceptable alternative way to ask if you’ll speak truthfully:
“Do you solemnly affirm under the penalties of perjury the information contained in your document is the truth?”

Notary qualifications
- Arizona resident at least 18 years old
- US citizen or permanent resident
- Proficient in reading and writing English
- Have no felony conviction unless civil rights were restored, and
- Have no other convictions involving issues of a nature that would be considered incompatible with notarial duties, such as fraud or identity theft
- Have no license revocation or suspension for any sort of dishonesty or misconduct in another profession (e.g. attorney or accountant)
An AZ notary can only legalize documents when they’re physically here in Arizona. Likewise, a notary’s commission (State’s permission to notarize documents) is not transferrable to other persons, nor is it transferrable if the notary moves to another state. In other words, only that authorized individual notary can notarize the document, and only when they’re both inside Arizona.
