Pretrial disclosures

Information to be disclosed includes all relevant data about witnesses, documents, and other evidence. The court uses these disclosures to make decisions, which is why it’s vital to properly prepare and file all required documents.

Which disclosures are mandatory?

Here in Arizona, any evidence not properly disclosed cannot be used during a trial. In family law cases, Rule 49 describes the requirements for disclosure, regardless of whether the other party asks you to provides documentation or not. Courts typically have a list of documents to be provided by the parties, including those that address mandatory financial questions in family matters.

If a case involves child custody and support issues, spousal maintenance, or unusual expenses, then an accurate Affidavit of Financial Information (AFI) must be completed and submitted. Many other disclosures can be decided privately between the parties, without becoming part of the public record.

Complying with rules of evidence

In Arizona family court cases, the rules for evidence can be fairly loose, with ordinary evidence considered admissible unless it is repetitive or abusive of the court’s resources. If the evidence seems relevant, a judge will generally allow it to be used at trial.

However, if one of the parties files a notice requiring strict compliance, then evidence presented to the court comply with all detailed requirements provided within the Arizona Rules of Family Law Procedure and other statutes.
